Terms of Service
Welcome to PrimeRoute Delivery. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and PrimeRoute Delivery ("PrimeRoute," "we," "us," or "our") governing your use of our delivery services and website.
IMPORTANT NOTICE
By using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services. Please read these Terms carefully before booking a delivery.
1. Acceptance of Terms
By accessing our website, making a booking, or using any of our delivery services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users, including customers, senders, recipients, and visitors.
2. Service Description
2.1 Delivery Services
PrimeRoute provides same-day delivery services between Toronto and the Niagara Region in Ontario, Canada. Our services include:
- Morning Delivery: Pickup in the morning, delivery same day (must book by 10 PM previous day)
- Afternoon Delivery: Pickup in the afternoon, delivery same day (must book by 11 AM same day)
- Multi-Stop Deliveries: Additional pickup and delivery locations along the route
- Express Handling: Direct transportation without sorting facilities or multiple handlers
- Proof of Delivery: Digital confirmation upon successful delivery
3. Booking and Payment
3.1 Pricing
Our pricing structure is as follows:
- Base Price: $59.99 for same-day delivery (one package, one pickup, one destination)
- Additional Stops: $39.99 per additional stop (pickup or delivery)
- Multiple Packages: Custom quote required - contact us for pricing
- Shopping Service: $10 (optional add-on for store pickup)
- All prices in Canadian Dollars (CAD)
3.2 Payment Terms
- Payment Methods: Credit/debit cards (via Stripe) or Interac e-Transfer
- Card Payments: Charged immediately upon booking confirmation
- Interac Payments: Must be received at least 2 hours before scheduled pickup
4. Prohibited Items
We will NOT transport the following items under any circumstances:
- Illegal substances or contraband
- Weapons, firearms, explosives, or ammunition
- Hazardous materials (flammable, toxic, corrosive, or radioactive)
- Live animals (except service animals with prior arrangement)
- Human remains or medical waste
- Currency or negotiable instruments exceeding $500
5. Cancellation and Refund Policy
5.1 Cancellation by Customer
- Before pickup: Full refund (cancel via customer portal or phone)
- After pickup: No refunds once package is picked up
- No-show or incorrect address: No refund; return fees may apply
6. Liability and Insurance
6.1 Limitation of Liability
Our liability is limited to the lesser of:
- The actual value of the item (with proof of value)
- $100 per shipment for uninsured items
- The declared value for insured items
- Three times the delivery fee paid
6.2 Optional Insurance
- Available for high-value items (over $100)
- Must be purchased at time of booking
- Cost: 2% of declared value (minimum $5)
7. Customer Responsibilities
You must provide accurate information, proper packaging, and be available during scheduled times. You agree to treat our staff with respect and comply with all applicable laws.
8. Dispute Resolution
Disputes will be resolved through informal negotiation first, then binding arbitration in Toronto, Ontario under the Arbitration Act, 1991 (Ontario).
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
